Unlike other firms, we guarantee that you will not be asked to pay any fees to progress your case, e.g. for disbursements, insurance and VAT.
In certain cases these fees can amount to thousands of pounds. Other solicitors and claims companies expect their clients to pay these fees themselves, or sign up to expensive loan agreements where interest and loan charges are deducted from damages.
We guarantee that you will not have to pay anything to pursue your claim while it is ongoing.
How Donoghue Solicitors is paid
When you win your case, the majority of your legal fees are paid by those responsible.
We will also agree a “success fee” which is only payable by you in the event you recover compensation.
This is our reward for taking the risk of not getting paid, agreeing that payment is delayed, and funding your legal costs in the meantime.
When you enter into a no win no fee agreement with us we agree in writing to limit this fee to only 25% of your damages for personal injuries (known in law as “pain, suffering, and loss of amenity”) and past financial losses, meaning that you will receive 75% of your compensation for them (subject to you also paying for optional “after the event” insurance, which we explain in the next section, and see * below. This limit applies to first instance proceedings only. The success fee is calculated with reference to our basic charges.)
What happens if you lose your case
In the unlikely event that your claim is not successful we promise not to claim any of our legal fees from you. This is written into the no win no fee agreement, so you know that it will be honoured.
If necessary and eligible, we will apply for an “after the event” insurance policy on your behalf. If you take out this optional cover, again at no up front cost to you, it will protect you from a claim for your opponent’s costs, your disbursements and other expenses.
That way, if you lose your case, you walk away owing nothing.
(If you take out an “after the event” insurance policy and win your claim its cost is payable by you in addition to our success fee. These things are only payable if you win. We will discuss if such a policy is necessary with you and only advise you to seek to take one out if it is in your best interests. We take no commission from the insurers if you take out an after the event insurance policy.)
